Arrested? Who Should Defend You
Tuesday, May 26th, 2009The Police have the power to arrest you with or without a warrant, in a number of circumstances.
They are too numerous to mention here but our advice is that you focus more on what you should say or not say to a Police Officer upon arrest rather than attempting to assert your rights prior to the arrest.
If you are wrong at the time you are trying to assert your rights then you can be arrested for obstruction or even more serious offenses.
It is better to co-operate fully and then argue the point at a defended hearing at a later stage.
You will be given the right to contact a lawyer as soon as you are back at the Police Station and you can get your full advice at that stage. You can also decide who you would like to defend you when you are there.
You are entitled to a lawyer paid by the State what ever your decision is.
